Your use of the website homeandaway.hsbc.com (the "Site") and the home&Away Privilege Programme (the "Programme") is conditional upon your acceptance of the following Terms and Conditions, as set out below from time to time:

Website Terms of Use

The following sets out the terms of use of the Site.

The Site provides information to customers of the HSBC Group about third parties who may be prepared to make offers and discounts available to certain customers of the HSBC Group and provides a portal or gateway to the financial services offered by members of the HSBC Group.

The Site is operated by us, a wholly owned subsidiary of HSBC Holdings plc, the holding company of the HSBC Group.

We are a founding member of the HSBC Group. Our head office is situated at HSBC Main Building, 1 Queen's Road, Central, Hong Kong.

All products and services provided by members of the HSBC Group in Local Sites are subject to the terms and conditions and disclaimers of the applicable agreement governing their supply and use ("Product terms and conditions"). Where Product terms and conditions conflict with these Terms and Conditions or any Local Site's terms and conditions the Product terms and conditions shall prevail.

The products and services offered on Local Sites may be limited to persons located or residing in only that particular jurisdiction. In addition, the content on these linked websites may not be intended for persons located or residing in jurisdictions that restrict the distribution of such content.

  • Both you and we play an important role in protecting against online fraud. You should be careful that your account details including your Username and/or Password are not compromised by ensuring that you do not knowingly or accidentally share, provide or facilitate unauthorised use of it. Do not share your Username and/or Password or allow access or use of it by others. We endeavor to put in place high standards of security to protect your interests.
  • You should safeguard your unique Username and Password by keeping it secret and confidential. Never write them down or share these details with anyone. We will never ask you for any HSBC Internet Password, including your Internet Banking Password, in order to ensure that you are the only person who knows this information. When choosing your unique Username and Password for the first time, do not create it using easily identifiable information such as your birthday, telephone number or a recognisable part of your name.     Occasionally we may collect personal information from visitors to this site and those individuals that participate in a contest or promotion (online or over the telephone, or at one of our branches). Such information is only collected from individuals who voluntarily provide us with their personal information. NOTICE TO CUSTOMERS RELATING TO THE PERSONAL DATA (PRIVACY) ORDINANCE (THE "ORDINANCE")

This Statement is made by us in accordance with the Personal Data (Privacy) Ordinance of the Hong Kong Special Administrative Region ('the Ordinance') and applies to customers of the Bank. For customers of other HSBC Group entities, please refer to the local privacy policy in your jurisdiction.
The Statement is intended to notify you why personal data is collected, how it will be used and to whom data access requests are to be addressed.

  1. From time to time, it is necessary for customers to supply the Bank with data in connection with the opening or continuation of accounts and the establishment or continuation of banking facilities or provision of banking services or compliance with any laws or guidelines issued by regulatory or other authorities.
  1. Failure to supply such data may result in the Bank being unable to open or continue accounts or establish or continue banking facilities or provide banking services or comply with any laws or guidelines issued by regulatory or other authorities.
  1. It is also the case that data are collected from customers in the ordinary course of the continuation of the banking relationship, for example, when customers write cheques, deposit money or apply for credit. This includes information obtained from credit reference agencies.
  1. The purposes for which data relating to a customer may be used are as follows:
    1. the daily operation of the services and credit facilities provided to customers;
    2. conducting credit checks [including without limitation upon an application for consumer credit (including mortgage loans) and upon periodic or special reviews of the credit which normally will take place one or more times each year];
    3. creating and maintaining the Bank's credit and risk related models;
    4. assisting other financial institutions to conduct credit checks and collect debts;
    5. ensuring ongoing credit worthiness of customers;
    6. designing financial services or related products for customers' use;
    7. marketing services, products and other subjects as described in (f) below;
    8. determining the amount of indebtedness owed to or by customers;
    9. collection of amounts outstanding from customers and those providing security for customers' obligations;
    10. meeting the requirements to make disclosure under the requirements of any law binding on the Bank or any of its branches or under and for the purposes of any guidelines issued by regulatory or other authorities with which the Bank or any of its branches are expected to comply;
    11. enabling an actual or proposed assignee of the Bank, or participant or sub-participant of the Bank's rights in respect of the customer to evaluate the transaction intended to be the subject of the assignment, participation or sub-participation; and
    12. purposes relating thereto.
  1. Data held by the Bank relating to a customer will be kept confidential but the Bank may provide such information to the following parties (whether within or outside the Hong Kong Special Administrative Region) for the purposes set out in paragraph (d):
    1. any agent, contractor or third party service provider who provides administrative, telecommunications, computer, payment or securities clearing or other services to the Bank in connection with the operation of its business;
    2. any other person under a duty of confidentiality to the Bank including a group company of the Bank which has undertaken to keep such information confidential;
    3. the drawee bank providing a copy of a paid cheque (which may contain information about the payee) to the drawer;
    4. a person making any payment into the customer's account (by providing a copy of a deposit confirmation slip which may contain the name of the customer);
    5. credit reference agencies, and, in the event of default, to debt collection agencies;
    6. any person to whom the Bank is under an obligation to make disclosure under the requirements of any law binding on the Bank or any of its branches or under and for the purposes of any guidelines issued by regulatory or other authorities with which the Bank or any of its branches are expected to comply;
    7. any actual or proposed assignee of the Bank or participant or sub-participant or transferee of the Bank's rights in respect of the customer; and
      1. the Bank's group companies;
      2. third party financial institutions, insurers, credit card companies, securities and investment services providers;
      3. third party reward, loyalty, privileges and co-branding programme providers;
      4. co-branding partners of the Bank and the Bank's group companies (the names of such co-branding partners will be provided during the application of the relevant services and products, as the case may be);
      5. external service providers (including but not limited to mailing houses, telecommunication companies, telemarketing and direct sales agents, call centres, data processing companies and information technology companies) that the Bank engages for the purposes set out in paragraph (d) (vii); and
      6. charitable or non-profit making organisations.

      9. Such information may be transferred to a place outside Hong Kong.
      In connection with (v) above,

    1. of all the data which may be collected or held by the Bank from time to time in connection with mortgages, the following data relating to the customer (including any updated data of any of the following data) may be provided by the Bank, on its own behalf and/or as agent, to the credit reference agency:
      1. full name;
      2. capacity in respect of each mortgage (as borrower, mortgagor or guarantor);
      3. Hong Kong Identity Card Number or travel document number or certificate of incorporation number;
      4. date of birth or date of incorporation;
      5. correspondence address;
      6. mortgage account number in respect of each mortgage;
      7. type of the facility in respect of each mortgage;
      8. mortgage account status in respect of each mortgage (e.g. active, closed, write-off); and
      9. if any, mortgage account closed date in respect of each mortgage.

      The credit reference agency will use the above data supplied by the Bank for the purposes of compiling a count of the number of mortgages from time to time held by the customer (as borrower, mortgagor or guarantor respectively, whether in sole name or joint names with others) for sharing in the consumer credit database of the credit reference agency by credit providers; and

    1. before the right referred to in (g) (v) below may be exercised, ( I ) in the event of any default in payment, unless the amount in default is fully repaid or written off (otherwise than due to a bankruptcy order) before the expiry of 60 days as measured by the Bank from the date such default occurred, the customer is liable to have his account repayment data retained by the credit reference agency at least until the expiry of five years from the date of final settlement of the amount in default and ( II ) in the event of any amount being written off due to a bankruptcy order being made against the customer, the customer is liable to have his account repayment data retained by the credit reference agency, regardless of whether the account repayment data reveal any material default, until the expiry of five years from the date of final settlement of the amount in default or the expiry of five years from the date of discharge from a bankruptcy as notified by the customer with evidence to the credit reference agency, whichever is earlier. Account repayment data include amount last due, amount of payment made during the last reporting period, remaining available credit or outstanding balance and default data [being amount past due and number of days past due, date of settlement of amount past due, and date of final settlement of amount in material default (if any)]. Material default is a default in payment for a period in excess of 60 days.
  1. Use of Data in Direct Marketing
    The Bank intends to use a customer's data in direct marketing and the Bank requires the customer's consent (which includes an indication of no objection) for that purpose. In this connection, please note that:
    1. the name, contact details, products and other service portfolio information, transaction pattern and behaviour, financial background and demographic data of a customer held by the Bank from time to time may be used by the Bank in direct marketing;
    2. the following classes of services, products and subjects may be marketed:
      1. financial, insurance, credit card, banking and related services and products;
      2. reward, loyalty, privileges or co-branding programmes and related services and products;
      3. services and products offered by the Bank’s co-branding partners (the names of such co-branding partners will be provided during the application of the relevant services and products, as the case may be); and
      4. donations and contributions for charitable and/or non-profit making purposes;
    3. the above services, products and subjects may be provided by or (in the case of donations and contributions) solicited by the Bank and/or:
      1. the Bank’s group companies;
      2. third party financial institutions, insurers, credit card companies, securities and investment services providers;
      3. third party reward, loyalty, privileges or co-branding programme providers;
      4. co-branding partners of the Bank and the Bank’s group companies (the names of such co-branding partners will be provided during the application of the relevant services and products, as the case may be); and
      5. charitable or non-profit making organisations;
    4. in addition to marketing the above services, products and subjects itself, the Bank also intends to provide the data described in paragraph (f)(i) above to all or any of the persons described in paragraph (f)(iii) above for use by them in marketing those services, products and subjects, and the Bank requires the customer's written consent (which includes an indication of no objection) for that purpose;
    5. the Bank may receive money or other property in return for providing the data to the other persons in paragraph (f)(iv) above and, when requesting the customer's consent or no objection as described in paragraph (f)(iv) above, the Bank will inform the customer if it will receive any money or other property in return for providing the data to the other persons.

    If a customer does not wish the Bank to use or provide to other persons his data for use in direct marketing as described above, the customer may exercise his opt-out right by notifying the Bank.

  1. Under and in accordance with the terms of the Ordinance and the Code of Practice on Consumer Credit Data approved and issued under the Ordinance, any individual has the right:
    1. to check whether the Bank holds data about him and of access to such data;
    2. to require the Bank to correct any data relating to him which is inaccurate;
    3. to ascertain the Bank's policies and practices in relation to data and to be informed of the kind of personal data held by the Bank;
    4. in relation to consumer credit, to request to be informed which items of data are routinely disclosed to credit reference agencies or debt collection agencies, and be provided with further information to enable the making of an access and correction request to the relevant credit reference agency or debt collection agency; and
    5. upon satisfactory termination of the credit by full repayment and on condition that there has been, within five years immediately before such termination, no material default under the credit as determined by the Bank, to instruct the Bank to make a request to the relevant credit reference agency to delete from its database any account data relating to the terminated credit.
  1. In accordance with the terms of the Ordinance, the Bank has the right to charge a reasonable fee for the processing of any data access request.

General Terms & Conditions of the home&Away Privilege Programme

Operation of the Programme

The home&Away Privilege Programme ('the Programme') introduces customers to third parties who may be prepared to make offers and discounts available to certain customers of HSBC. 

All offers detailed on this Site are provided by third parties and subject to their terms and conditions. If you have any queries regarding any of the offers, please contact the third party who is providing the offer.

The third party offers are promoted on the Site, which is operated by us. Country-specific terms may apply to the offers from time to time available in different countries.

Eligibility to Participate in the Programme

Please see the specific eligibility criteria of each third party offer.

Generally, the third parties will make any offers available to holders of an Eligible Card.

An 'Eligible Card' means a credit card bearing the 'HSBC' name and logo, any credit card issued by an HSBC Group member or any other credit card notified in writing by us to you as being an Eligible Card from time to time but excluding certain co-branded credit cards as specified by us or other HSBC Group member(s) from time to time (which may be different from territory to territory) (unless expressly stated otherwise in respect of any benefit, any Programme Participant or any jurisdiction on this Site or otherwise). Third parties may only make certain offers available to holders of particular cards. Please refer to the specific eligibility criteria of each third party offer for further details.

HSBC may terminate your use of the Programme immediately without notice and for any reason (unless otherwise required by relevant regulatory bodies/agencies/court order in which event we will comply with relevant legal, regulatory or judicial requirement), including if you:
a. do not comply with the Terms and Conditions;
b. do not comply with the terms and conditions of an Eligible Card;
c. cease to be the holder of an Eligible Card (i.e. your account is cancelled); or
d. abuse any privilege offered to you under the Programme.

Benefits Under the Programme

The offers and discounts are listed on the Site and may also be listed in general advertising material from time to time.

The offers promoted on the Site may be changed or withdrawn at any time without prior notice either by HSBC or by third party offer provider.

All offers and discounts are subject to availability and other terms and conditions imposed by the third party providers of the offers.

Unless otherwise stated, no offer or discount may be used in conjunction with any other offers, discounts, promotional offers or programmes, discounted items, shopping and dining coupons, membership benefits, fixed-price items, privilege card(s), loyalty programmes, or in-house offers. The offers, and any rights they confer, cannot be sold, transferred, assigned, exchanged for cash, other products or discounts or otherwise dealt with except in accordance with the Terms and Conditions.

To claim an offer you must follow any specific instructions of the third party as detailed on the Site or as subsequently notified to you by the third party. In general, in order to claim an offer, you should:

  1. state the redemption of the offer during any advance booking; and
  2. settle payment with your Eligible Card or quote details of, show or use your Eligible Card at the time of transaction; If an offer is only available to HSBC Premier credit cardholders, such cardholders must settle payment with their HSBC Premier MasterCard® credit card, and to enjoy exclusive offers available to Visa Platinum cardholders, such cardholders must settle payment with their HSBC Visa Platinum card.

Limitations and conditions may apply in relation to offers and availability of such offers during public holidays, festivities or other dates as specified by the respective third party providers. Please check with respective third party providers for details.

Liability

  6. the suspension and/or termination of the Programme; or
  7. any malfunction, delay in replacing, or unauthorised use of Eligible Cards. The provisions of this sub paragraph (g) shall not apply if the Eligible Card was issued in any of the United Kingdom, the countries of the European Union or countries in the European Economic Area.

The third party providers of the offers and discounts do not have any authority, express or implied, to make any representations, warranties or statements on behalf of any HSBC Group member. All contractual obligations are between you and the third party provider.

Any tax which is payable arising from your participation in the Programme is your responsibility, including any goods and services tax.

Terms & Conditions of the home&Away Online Booking Service

  1. The home&Away Online Booking Service is valid during promotion period until 31 Dec 2012.
  2. The home&Away Online Booking Service is available to holders ("Cardholders") of HSBC credit cards issued from countries specified under the 'Country of Residence' section of the Site.
  3. The Online Booking Service is applicable to restaurants with '+ Booking Cart' function on the Site and such restaurants also accept advance booking reservation.
  4. All booking requests must be made via the Site and are not applicable to telephone reservation. Cardholders must settle the payment with an HSBC credit card in order to enjoy the Online Booking Service.
  5. The Online Booking Service is only applicable to booking or revision request made between 48 hours to 1 month from the date of booking request is submitted.
  6. A maximum of 5 restaurants can be booked per request.
  7. Cardholders are required to complete all information (in English) in the booking form in order to process the booking or revision request*.
  8. The booking requests will be processed by the third party provider from the time of submission and upon receipt of the booking result from respective restaurants. Neither we nor any HSBC Group member warrants the availability, success or failure or delay of any of such booking requests made via the Site.
  9. Neither we nor any HSBC Group member accepts any liability or obligations of such booking result as replies from the respective restaurants and Programme Participants may vary. Please check with respective restaurants and Programme Participants for details.
  10. The booking service may not be available during special occasions, public holidays, festivities, promotional period or other dates as specified by the respective restaurants and Programme Participants. Please check with respective restaurants and Programme Participants for details.
  11. Revision booking is only applicable to date, time and number of diners.
  12. Cardholders have to contact respective restaurants and Programme Participants for cancellation of booking.
  13. Cardholders may be contacted by restaurants and Programme Participants separately to re-confirm booking subject to the common practice of individual restaurants and Programme Participants.
  14. Neither we nor any HSBC Group member accepts any responsibility for any changes of the respective booked restaurants or Programme Participants after Cardholders have received the email notification. Please check with respective restaurants and Programme Participants for details.
  15. The Online Booking Service will be provided subject to the local laws and regulations of the place where the restaurant is located and, in the event of any conflict between these terms and conditions and any applicable laws and regulations, the latter shall prevail.
  16. We reserve the right to vary the terms and conditions of these Online Booking Services at any time without prior notice.
  17. In the case of any dispute, our decision and that of the respective restaurants and Programme Participants shall be final.
  18. Subject to Clause 17 above, these Terms and Conditions for online booking service shall be governed by the laws of the Hong Kong Special Administrative Region.
